Cycle locker
- The Licensor permits the Licensee to use the Facility for the exercise of the Privileges from and including the Licence Commencement Date up to and including the Licence Cessation Date subject to the terms and conditions laid down elsewhere in this Licence.
- Only the Licensee is permitted to exercise the Privileges. The Licensee shall not assign or transfer this Licence nor grant any right to any other party to use the Facility
- The Licensee accepts that the use of the Facility and the exercise of the Privileges are undertaken entirely at his own risk. The Licensor offers no guarantee as to the capability for the exercise of the Privileges or the security of the Facility.
- The Licensee shall have the option to renew the Licence.
- Should the Licensee wish to exercise the renewal option stated in clause 4, the Licensee shall give notice to the Licensor no later than 28 days prior to the Licence Cessation Date.
- The Licensor shall, subject to giving the Licensee 7 days notice, have the right to terminate this Licence at any time and for any reason except in the case of emergency when this Licence may be terminated immediately.
- The Licensee shall have the right to surrender this Licence at any time.
- The Licensee shall pay to the Licensor upon request the Deposit.
- Upon receipt of the Deposit the Licensor shall issue the Licensee with a lock and key. The Licensee shall use no other means of locking the locker other than with the lock and key provided by the Licensor for that purpose.
- The Deposit shall be held by the Licensor until such time as:
- The lock and key is returned by the Licensee on or before the Licence Cessation Date.
- The lock and key is returned by the Licensee following surrender of this Licence by the Licensee.
- The lock and key is returned by the Licensee following the termination of this Licence by the Licensor. when subject to clause 11 the Deposit shall be returned to the Licensee.
- The Licensee shall forfeit the Deposit in the event that:
- The Licensor terminates the Licence due to the Licensee using the Facility for purposes other than the Privileges.
- The Licensor terminates the Licence due to the Licensee allowing persons other than himself to use the Facility.
- The lock and key are not returned on or before the Licence Cessation Date.
- The Licensee loses or damages the lock or key beyond use.
- The Licensee is deemed responsible by the Licensor for any damage to the Facility. Such responsibility to be determined at the absolute discretion of the Licensor.
- The Licensee fails to vacate the Facility on or before the Licence Cessation Date, the surrender of the Licence by the Licensee or within 7 days of receipt of a notice of termination by the Licensor.
- Any property remaining within the Facility following; the Licence Cessation Date, the surrender of the Licence by the Licensee or after 7 days of receipt of a notice of termination by the Licensor, shall be removed and treated as left luggage which may require the payment of a fee for retrieval.
- Any property remaining within the Facility following termination of the Licence due to an emergency shall be removed and treated as left luggage but shall be returned free of charge providing that such an emergency did not arise due to the misuse of the Facility.
- The Licensor shall replace, free of charge, for the benefit of the Licensee, any lock upon the Facility which becomes faulty or damaged by causes other than misuse or abuse by the Licensee.
- The Licensee shall, within 5 working days of receipt of a notice, make available the Facility for inspection by the Licensor in the event that the Licensor believes the Facility is being used for purposes other than the Privileges. Except in the case of emergency when the Licensor may exercise immediate access to the Facility.
- The Licensor accepts no liability for any loss or damage (including personal injury or death) arising from the use of the Facility or the exercise of the Privileges except where such liability is a result of any negligence by the Licensor.
- Any notice served under this Licence is to be treated as effectively served if and only if sent by First Class Post addressed to the Licensee or Licensor at the address stated upon this Licence or such other address as either party may from time to time direct and shall be deemed, in the absence of evidence of earlier receipt, two days from the date of postage.
- Any reference within this Licence to the Licensor shall include the servants and agents of the Licensor and any reference to one gender shall equally refer to the other gender.
- Bicycles that appear to have been abandoned for a period of 6 weeks will be tagged with a notice prior to their removal. Attempts will be made by WMCA to contact bicycle owner. A period of seven days will be given for the bicycle to be removed and/or the Owner to contact WMCA for more information. If after that time the owner has not made contact with WMCA and the bicycle still remains then it will be removed and placed into storage. If after 6 weeks of being placed in storage the bicycle has still not been claimed, then it should be disposed of at WMCA’s discretion.
